Terms and conditions of Party.San GmbH für das Party.San Metal Open Air
- By purchasing a festival ticket, the festival attendee expressly acknowledges the General Terms and Conditions as well as the site regulations for the Party.San Metal Open Air.
- Entry to the event grounds (i.e. the entire area including the camping site/parking areas and festival site) is only allowed with a valid ticket. Further access to the event grounds and entry to the festival area (i.e. the arena) is only allowed with a so-called visitor wristband. This wristband is given to the festival attendee in exchange for a valid admission ticket at the wristband exchange stations, as indicated on the event map. The ticket will be canceled there and thus loses its validity. The wristband must be worn for the entire duration of the stay. It is non-transferable and will not be replaced if lost or damaged.
- Reselling the purchased admission ticket is generally prohibited.
- The organizer reserves the right to refuse entry to the festival attendee for an important reason or to ban them from further staying on the event grounds. In this case, the festival attendee is only entitled to a refund of the face value of the ticket. However, no refund will be given if the refusal of entry is due to an important reason related to the person of the festival attendee. Any further claims for damages are excluded, unless the organizer acts with gross negligence or intent.
- The organizer reserves the right to cancel the event before it begins without providing reasons. In the event that the event is canceled before the start, the attendee is entitled only to a refund of the face value of the ticket (excluding the advance ticket sales fee). No further claims for damages can be made.
- The event will generally take place regardless of weather conditions as long as the organizer can manage the weather circumstances. However, if weather conditions pose a risk to the health and safety of festival attendees, artists, or staff, the event will be immediately canceled. In this case, as well as in the event of cancellation due to force majeure, authorities' orders, or judicial decisions, or if the safety of festival attendees is at risk due to the misconduct of others or due to the threat of escalation from large crowds, no refund or compensation is owed unless the organizer acted with gross negligence or intent.
- The organizer reserves the right to relocate the entire event, either geographically or temporally. Such changes will be announced as early as possible, but at the latest one week before the event starts. The organizer also reserves the right to make last-minute changes to the festival program. Changes will be announced as early as possible, but can also occur during the festival. Changes during the festival will be communicated to the visitors through appropriate measures (posters, etc.). There is no right to a refund and/or compensation, unless the organizer acts with gross negligence or intent.
- The organizer reserves the right to restrict access to certain areas of the festival grounds, such as stages, for safety reasons, due to overcrowding. No right to refund or compensation exists in these cases.
- A security check will take place at the entrance to the festival grounds. By purchasing the ticket, the festival attendee expressly agrees to being scanned for prohibited items by security personnel.
- The festival attendee has the option to park their vehicle on the festival grounds for a fee. They must purchase a parking ticket in the form of a parking sticker, which must be displayed clearly and fixed to the vehicle’s windshield. The festival attendee also has the option to camp in designated areas for a fee. Parking and camping are at the attendee's own risk. The organizer is not liable for any damages or theft unless it can be proven that the organizer acted with intent or gross negligence.
- The organizer is also not liable for lost or stolen property.
- Any claims for compensation against the organizer due to negligence are excluded. This also applies to its legal representatives or agents. This provision does not apply to damages arising from injury to body, life, or health, as well as in cases of gross negligence or intent on the part of the organizer or violation of essential contractual obligations, where the compensation claim is limited to foreseeable, typical damage. Further liability is excluded.
- The organizer is also not liable in cases of force majeure. Force majeure refers to unavoidable events such as natural disasters of any kind, including severe weather, hurricanes, earthquakes, floods, volcanic eruptions, as well as fire, war, civil unrest, revolution, terrorism, sabotage, strikes, nuclear/reactor accidents.
- The organizer explicitly points out that music festivals are environments with high sound levels. The organizer takes necessary precautions to prevent permanent hearing or health damage. Festival attendees are strongly advised to use earplugs or other sound-protecting means (such as noise-canceling headphones) to protect themselves from possible hearing or health damage. Attendance at the event is therefore expressly at the attendee's own risk. The organizer is not liable for hearing or health damage due to lack of precautions unless the organizer acts with gross negligence or intent. Earplugs are available at the official merchandise stand and at the help desks.
- By purchasing the festival ticket, the festival attendee expressly and irrevocably consents to the free use of their image and possibly their voice for photographs, live broadcasts, broadcasts, and/or recordings of image and/or sound made by the organizer or its agents in connection with the event, as well as their subsequent exploitation in all present and future media (such as audio and visual recordings) and digital distribution, e.g. via the Internet.
- The festival grounds and the parking and camping areas are located on an airfield. Damage to signal or flight safety systems, green areas, fences, runways, or takeoff/landing areas will be reported to the authorities and prosecuted. It will also lead to an immediate ban from the event.
- The house rules for the entire event area are exercised by the organizer or specially authorized third parties (e.g., security personnel).
- Glass containers of any kind, pyrotechnic items and torches, weapons of any kind, or objects that can be used as weapons are prohibited throughout the entire event area.
- Also prohibited on the entire festival grounds (in addition to point 18) are cans, plastic bottles, PET bottles, cans, barrels, Tetrapaks with more than one liter capacity, personal food, hard packaging, coolers, or other heavy containers, as well as spray cans of any kind. Non-alcoholic drinks in sealed Tetrapaks of up to 1 liter are allowed.
- Photography for personal use is generally permitted with compact cameras and mobile phones with camera functions. Professional cameras with zoom lenses and/or video functions as well as professional audio recording devices of any kind are not allowed. Video and audio recordings of any kind are prohibited without the express permission of the organizer and/or the respective artist. Unauthorized publication of such recordings will be reported to the authorities and prosecuted.
- Any commercial activity by festival attendees is prohibited without prior written consent from the organizer.
- Climbing on stages, trusses, structures, fences, containers, flight-related equipment, or similar is strictly prohibited. Any violation will lead to exclusion from the event.
- The provisions of the Youth Protection Act (JuSchG) apply. Children and young people under 16 years of age are not permitted to attend public dance events without a legal guardian or authorized person. Young people aged 16 and over are only allowed to stay until midnight unless accompanied by a legal guardian or authorized person.
- Animals are not allowed on the entire event grounds and are prohibited on the festival grounds.
- For all disputes arising from contractual or legal grounds, the jurisdiction of Weimar, Germany is agreed upon, and German law exclusively applies.
- If the General Terms and Conditions become part of the contract either in whole or in part or are invalid, the rest of the contract remains valid. Where provisions are not part of the contract or are invalid, the content of the contract is governed by the statutory provisions.
